Letter from Withers, solicitors of the executors of the
executors of the last surviving trustee


The original Trustees are dead, Paul Niekirk died in1974 and Giles Vandeleur was the last surviving trustee and he died in 1979.  Giles Vandeleur executor of his Will was Author Collins a Solicitors of Withers, his executors of his Will executors had refused to act see above letter.

In October 1970, Withers Solicitors went to the Chancery in London and made Hamilton O'Malley the only beneficiary to the said Capital of the Marriage Settlement 14th Feb. 1941.

 Withers Solicitors also arranged with other solicitors to do the same in America.

Evidence indicates Withers Solicitors were accountable for formally denying issue of Major Hamilton O'Malley to enable to make Hamilton O'Malley the absolute beneficiary of the herein said Marriage Settlement 1941, meaning the Capital would go under Hamilton O'Malley's Will and Trustees will not be taxed:-

Prior to Withers formally making the Marriage Settlement 1941 made by Captain Hamilton, as Hamilton O'Malley being the only beneficiary, thus denied issue, arrangements were made by Gerald Finley of Gerald Finley & Co Hamilton's family American Lawyer with various solicitors, to include John Sherbrooke of Slade & Co later Humphrey & Kirk of Swanage Sadie's family lawyers and Pauul Nirkirk of Bull & Bull of London Hamilton's lawyer and trustee and Royds solicitors in London who prepared the marriage settlements 1941 made by Lady Iris, had arranged to get rid of Lady Iris Mountbatten's daughter by Hamilton and also her son by her second marriage (Lady Grace Mountbatten aka Grania,  and Robin Bryan) out of the picture. Lady Grace Mountbatten the only contingent beneficiary to the whole of the capital of this said Marriage Settlement 1941, to include the interest of both her parents Lady Iris and Captain Hamilton.

Lady Grace also has an interest in the Edward Malley Estate, the Mathew Byrnes Estate, Jane O'Malley-Keyes Estate, Hamilton O'Malley Estate and also to Middleton O'Malley a JP Estate of Ross House upon her paternal line. Plus she has her maternal line, an interest in her mother Lady Iris Mountbatten Estate plus of her maternal grandmother Irene Mountbatten Estate. She also is contingent beneficiary to a Marriage Settlement dated 14th February 1941 made between Lady Iris Mountbatten and Captain Hamilton O'Malley, a British Trust, to include both her said parents' interests in the said settlement.

Due to lack of Funding she has been unable to pursue the matter to obtain her inheritance.

Giles Vandeleur, the last surviving trustee withdrew some capital from the said marriage settlement  1941 to new trustees re. voluntary payments by Hamilton O'Malley to Sadie (John Sherbrooke Director of Slade & Co or Slade & West later called Humphrey & Kirk Solicitors were Solicitors of Sadie and of her family, John Sherbrooke now deceased Simon Sherbrooke his son took over):




The Reversary Interest of the said above 'Withdrawn Trust Fund' was illegally sold in September 1989.  The Nominal Capital executed to the wrong person/s.

Simon Sherbrooke of Humphrey & Kirk preparing for tax rebate for Sadie (below), Sadie never paid taxes! Yet she received tax rebates! The Capital was under Hamilton O'Malley therefore, he paid the tax.  There were also failure of account to Sadie she only received 300 sterling per month.
'Withdrawn Trust Fund' Tax rebate form:-


Hamilton O'Malley also gave voluntary payments to Sadie of 2 Church Street of the Edward Malley Estate. The exact income per month is yet to be investigated.  This voluntary payment from Hamilton O'Malley was called the 'Main Trust Fund' once it arrived in England.  

Evidence suggests that Slade & Co later Humphrey & Kirk received the income of 2 church street direct to them.  Sadie's lawyers had petitioned against Gerald Finley's Will in 1976 re. 2 Church Street re. balance owing.

This capital called the 'Main Trust Fund' is capital from 2 Church Street, capital withdrawn from the said Marriage Settlement 1941 made by Hamilton O'Malley.



 




Evidence indicates that the above 'Withdrawn Trust Fund' under Captain Hamilton O'Malley's name is invested in Bournemouth or/and Poole Corporation since 1976, since transfer of new Trustees as above, this is yet to be verified or confirmed by Bournemouth or Poole Corporation/Treasury Dept.  

The Capital has not been executed to the contingent beneficiary of the Marriage Settlement 1941 made by Captain Hamilton O'Malley, the said Lady Grace Mountbatten born 31st July 1946.
The Reversary interest was sold in September 1969, illegally and executed to the wrong persons and the nominal capital has not been executed to the appropriate beneficiary either.  

The new Trustees once appointed, one of the new trustees John Sherbrooke, a solicitor and director and one of the trustees of then Slade & Co later Humphrey & Kirk followed in 1976 to contact Burks Peerage and gave false information concerning the daughter of Captain Hamilton O'Malley, to enable to have full control of the capital of the 'withdrawn trust fund'.

Hamilton O'Malley voluntary payments to his third wife:- 

Hamilton O'Malley and Betty's Gibraltar Lawyers - Isola & Isola:-

Capital withdrawn from the Marriage Settlement 1941 transferred to Isola & Isola in Gibraltar/ they claim a Will was made by Hamilton O'Malley under the name of Hamilton O'Malley-Keyes whereas the executers/trustees are Elezabeth O'Malley-Keyes and William Isola of Isola & Isola.  This said capital 2 Bonds was transferred to Hambros Bank in December 1989

Betty lived off the income from these bonds until she died.  Isola & Isola still in possession of these two Bonds in Hambros Bank.  These two Bonds belong to the Marriage Settlement dated 14th Feb. 1941 made by Captain Hamilton.  The capital has not been executed to the appropriate contingent beneficiary of the Marriage Settlement 1941.


Accordingly to Hamilton O'Malley's English Bank Lloyds of Pall Mall in London (for Army Officers) 3,500 sterling was executed in 1989 to the Trustees of his Will, Isola and Isola and Betty.

Hamilton O'Malleys Estate has not been executed to his issue to this day.  Isola & Isola are the executors of his Will.

Hamilton O'Malley supposedly of died on 31st March 1989.  The Funeral Directors in Benalmadena that dealt with his funeral confirmed that there was a Mass in a Church with a coffin supposedly with the body of Hamilton O'Malley, but no evidence on record, a body was in the coffin, and that his body nor a coffin was cremated nor buried nor transferred to any place or country accordingly to their records!  Hamilton O'Malley's body is missing up today.
