This Hearing was about Christopher Wright not complying to the Court Order 1 (b) May 2011 and Court Order 2  October 2013   (twice not complied).  

Decision by the Court dated 27th January 2014:
case re. the theory or possibility that the Royal Trust Corporation of Canada are trustees of the Marriage Settlement 14th Feb. 1941 is dismissed by Lady Grania Mountbatten, as there is no evidence to suggest that they were appointed trustees.





     

Mr. Wright was unable to present evidence that the Royal Trust Coporation of Canada bank in Toronto are trustees of the Marriage Settlement dated 14th Feb. 1941 made by Lady Iris Mountbatten, as a result the theory of the possibility that they were is dismissed by Lady Grania Mountbatten is closed.

The Marriage Settlement 1941 may of been made Lady Iris 'absolute' as a result the executors of the last surviving trustee may of administered the capital to Lady Iris account in the Royal Trust Corporation of Canada bank soon after her death in 1982.  The Trust would of ended upon the death of the Settlor, Lady Iris Mountbatten.

Accordingly ton Robin Bryan claims, he received only $250.000 Canadian dollars only, and it was spent.  Plus a property and its contents and Princess Beatrice of Battenberg's broach.

Mr. Wright has the original Marriage Settlement 14.02.1941 in his possession.

this 1947 settlement has nothing to do with Lady Grania Mountbatten -
this said deed by appointment made by Lady iris dated in May 1947 was made in favor of a future
husband and issue.  This said settlement was mention on Alexander Mountbatten, Marquess of Carisbrooke Will, he died in 1960, for capital after sale of goods to be transferred into the settlement 1947 and invested.  Robin apparently did not receive any more cash than $250.000 canadian dollars in 1984, so he claimed  other than a house and contents.  The Royal Trust Corporation of Canada apparently were involved in the final distribution of Iris Kemp Will (believed to be Lady Iris Will) as Robin did not wish to act. The Will clearly states that if Robin does not wish to act  that the Trusteeship of her Will be transferred to Royal Trust Corporation of Canada.

No proof has been provided from Royds (a breach of the Court order 1(b),  re Royal Trust Corporation of Canada are Trustees of the Marriage Settlement dated 14th February 1941 nor that of the Settlement dated 1947.

Captain Hamilton O'Malley had an interest in the Marriage Settlement dated 14th February 1941 made by Lady Iris Mountbatten.  Christopher Wright of Royds Solicitors had confirmed in Court on 3rd May 2011, Captain Hamilton had not received his interest.  Lady Grania Mountbatten, the Applicant, is a contingent beneficiary to the whole of the interest of this said Marriage Settlement dated 14th February 1941 made between Lady Iris Mountbatten and Captain Hamilton O'Malley.

The Executors of the last surviving Trustee Cyrell George Randolf, a Banker of 1 Fleet Street, London, are responsible to administer the Capital to the contingent beneficiary (myself, the Applicant) as the Trustee did not administer the estate to the contingent beneficiary Lady Grania Mountbatten.  

There is not any evidence/proof whatsoever that Lady Iris Mountbatten had appointed the Royal Trust Corporation of Canada as Trustees of the this said Marriage Settlement 1941 in 1968 as alledged by Christopher Wright of Royds Solicitors nor has the Royal Trust Corporation of Canada or Royds Solicitors provided proof to support such claims. The RBC only say 'as a trustee', in their letter, they do not say of what nor presented proof nor are they willing to have communication with a lawyer to clarify the matter nor with their partners!
